High Court Declares Level 3 Lockdown Regulations Invalid and Unconstitutional

According to a media release on Tuesday, the High Court has declared Alert Level 3 regulations invalid and unconstitutional.

The Gauteng Division of the High Court has suspended the declaration of invalidity for the next 14 days. This means that for the next 14 days the alert level 3 regulations will remain in operation.

Cabinet says it will study the judgment on Alert Level 3 regulations and says the government will take it into consideration. 

Minister of Cooperative Governance and Traditional Affairs, in consultation with the relevant Ministers, has been directed by the High Court to review, amend and republish the regulations with “due consideration to the limitation each regulation has on the rights guaranteed by the Bill of Rights.”

According to the media release, Cabinet will make a statement once the judgement has been carefully evaluated.
