Court Rules in Favour of Empolweni Residents

According to GroundUp, the Western Cape High Court on Friday ruled in favour of the residents of the Empolweni informal settlement whose homes were demolished by the City of Cape Town.

The report says Judge Bryan Hack’s ruling said the City must allow 130 people to return to Empolweni. The City was also ordered to give residents their building material back or ensure that there is sufficient material for all 49 homes to be rebuilt.

According to GroundUp, the order is one condition that no more people move to the site. Community members of Empolweni have agreed to prevent more structures from being built. “If they are unable to prevent further building, they are to report this to the City through their attorneys at the Legal Resources Centre”

Friday’s judgement only relates to the urgent matters of restoration of materials and permission to return to the Empolweni site. The court will reconvene and the matter will be heard in full after the COVID-19 lockdown has ended.
